⁋ Terms of Service

Article 1 (Purpose) These Terms of Service ("Terms") govern the rights, obligations, and responsibilities between SmartChurch ("Company") and users ("Members") regarding the use of the services provided by the Company. Article 2 (Definitions) 1. "Member" means a person or organization that agrees to these Terms and registers for the Service. 2. "Service" means website creation, church bulletin publishing, content management, and related features provided by the Company. 3. "Content" means any text, image, video, audio, document, or other material uploaded by Members. Article 3 (Agreement) 1. A service agreement is established when a user agrees to these Terms and the Company accepts the registration. 2. The Company may refuse registration if the applicant violates applicable laws or these Terms. Article 4 (Voluntary Support) 1. SmartChurch operates under a voluntary support model. 2. Members may voluntarily contribute financial support to help maintain and improve the Service. 3. Failure to contribute shall not restrict access to the Service. 4. Voluntary contributions are not charitable donations and are not tax-deductible. 5. Voluntary contributions are non-refundable except where required by applicable law. Article 5 (Member Responsibilities) Members agree not to: 1. Violate applicable laws or regulations. 2. Infringe intellectual property, privacy, or other rights of others. 3. Upload malicious software or harmful content. 4. Use the Service for fraudulent, deceptive, hateful, or unlawful purposes. 5. Attempt unauthorized access to the Service. Article 6 (User Content) 1. Members retain ownership of the content they upload to the Service. 2. Members grant the Company a limited, non-exclusive license to host, store, process, display, and distribute such content solely for operating and providing the Service. 3. Members are solely responsible for the content they upload. Article 7 (Termination and Restrictions) 1. The Company may suspend or terminate accounts that violate these Terms. 2. The Company may refuse or terminate service for organizations or individuals engaged in illegal, fraudulent, violent, hateful, or unlawful activities. 3. When reasonably possible, the Company will provide prior notice before suspension or termination. Article 8 (Withdrawal and Data Retention) 1. Members may request account deletion at any time. 2. Following account deletion, data may be retained for up to 30 days. 3. After the retention period, data may be permanently deleted and may not be recoverable. 4. Certain information may be retained longer where required by applicable law. Article 9 (Service Changes and Availability) 1. The Company may modify, suspend, or discontinue all or part of the Service at any time. 2. The Company will provide notice when reasonably possible. 3. The Company does not guarantee uninterrupted, secure, or error-free operation of the Service. Article 10 (Backups) Members are responsible for maintaining backups of their own content. The Company does not guarantee restoration of deleted or lost content. Article 11 (Disclaimer) THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Article 12 (Limitation of Liability) TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. THE TOTAL LIABILITY OF THE COMPANY ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED USD $100. Article 13 (Privacy) Use of the Service is also governed by the Company's Privacy Policy. Article 14 (Governing Law) These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to conflict of law principles.
